Apple Corps, the Beatles’ company, has filed a $100 million trade mark infringement lawsuit. The lawsuit is filed in Florida and against almost 50 online retailers, all of which are accused of trade mark infringement. The online retailers have allegedly sold products, which infringe the Beatles “Beatles” and “Yellow Submarine” trade marks, on their websites and platforms such as Amazon and eBay.
The allegedly infringing goods have been stated to come in all shapes and sizes, from onesies to tank tops.
The filed claim states: “The natural and intended byproduct of defendants’ actions is the erosion and destruction of the goodwill associated with plaintiffs’ respective famous names and trademarks and the destruction of the legitimate market sector in which they operate,”
The lawsuit is claiming approximately $2 million per infringer and there is 50 of them! One may agree that this amount does seem to be high; on the other hand one may let it be.
