After a years-long copyright infringement battle lawsuit against Ed Sheeran’s track ‘Thinking Out Loud’ a federal judge has declared that it will proceed a trail, despite Sheeran’s motion for dismissal.
Ed Sheeran will now have to go before a jury for them to decide on the verdict after hearing evidence from both sides of the case. Ed and his co-writer Amy Wadge are being sued for £90 million in damages by a company called Structured Asset Sales, who own part of Marvin Gaye’s track ‘Let’s Get It On.’
The claim states that Sheeran’s track’s “melody, rhythm, harmonies, drums, bass line, backing chorus, tempo, syncopation and looping” has been copied and exploited without authorisation or credit to Gaye.
At one point, there was accusations that they stole the chord progressions to make ‘Thinking Out Loud.’ However, it is impossible to copyright chord progressions and use them as evidence of plagiarism in court.
Ed Sheeran has spent a lot of this year in court. Sheeran’s hit ‘Shape of You’ spent weeks in court at the beginning of this year after her was accused of copyrighting a hook. The case was subsequently thrown out.
