The Pirate Bay is probably one of the most popular websites on the internet. It is often used by its users to commit various forms of piracy. The Pirate Bay does this primarily by allowing their users to share a variety of illegal torrents. Because of this, The Pirate Bay has often been subjected to countless threats of penalties & litigation by organisations around the world. Often times when faced with these “hindrances”, The Pirate Bay simply moves its servers or changes its country code top-level domain (CCTLD). For those of you not familiar with a CCTLD, it is a domain name that is reserved for a specific specific country. For example, .uk is the United Kingdom’s CCTLD. Different states have different levels of stringency of rules for registering a CCTLD. I’m not a hundred percent familiar with the intricacies of domain name registration, but from what I can gather changing the CCTLD is enough to dissolve a domain name from most of its legal obligations.
The Pirate Bay changes its CCTLD a lot; in 2013 alone the Pirate Bay has changed its CCTLD six times. Earlier in this year the Pirate Bay was registered under the cctld .sx (a cctld that is reserved for the Caribbean island of Sint Maarten); it then shortly changed to .ac (a CCTLD reserved for the British controlled Ascension Island); before settling in with .pe (a CCTLD reserved for Peru).
What’s more interestingly however is the fact that a spokesman for the Pirate Bay said that a new system is under development which will make domain names completely irrelevant. When this is done, users will be able to access all links and websites with the same level of ease through a completely legal piece of browser software. However, the website and domain itself will not be located in any jurisdiction. I don’t know the exact technicalities of the matter, but the bottom line is that if this system is successfully developed The Pirate Bay (and presumably other website) will not be in any recognised jurisdiction. Thus, they will effectively be impenetrable by any organisation or authority.
